Terms of Service for patients

1. Introduction

1.1 These terms of service govern your use of the Mindoo platform, and any questionnaires or intakes offered through it.

1.2 This is a legal agreement between you and MINDOO AI BV, a company organized under the laws of Belgium, having its registered office at Moonsstraat 29 bus 302, 2018 Antwerp, Belgium and with company number BE1018.909.873 (RLE Antwerp, division Antwerp) (hereinafter “Mindoo”).

1.3 By clicking “I agree”, using the Mindoo platform, or filling out a questionnaire, you accept these Terms of Service. If you do not agree, you may not use or access the Mindoo platform.  

2. License Grant

2.1 Mindoo gives you a personal, limited, revocable, non‑exclusive, non‑transferable and non‑sublicensable right to use the platform solely to fill out pre‑anamnesis questionnaires in preparation for your appointment with a medical professional.

2.2 The extent of the foregoing license is restricted to the scope expressly set forth herein and there are no implied licenses hereunder. Mindoo reserves any right not expressly granted to you hereunder.

3. User Eligibility  

3.1 To access and use the questionnaires provided through the Mindoo platform, you must:

(a) be at least eighteen (18) years of age; and

(b) have your place of residence in the European Union.

3.2 If you are under eighteen (18) years of age, you may only use the questionnaires provided through the Mindoo platform with the permission of your parents or legal guardians and under their supervision.

4. Use Restrictions

4.1 You may only use the Platform to complete pre‑anamnesis questionnaires, and you may not use the Platform for any other purpose. Without prejudice to the generality of the foregoing, you may not use the Mindoo Platform to:

(a) distribute or engage in harassment, abusive language, offensive behavior, or any form of disrespectful conduct;

(b) upload, introduce, or attempt to introduce malicious code or software;

(c) misrepresent your identity or impersonate another person;

(d) collect or attempt to collect personal data of other Users, whether manually or automatically, including through the use of robots, spiders, crawlers, search or retrieval applications, or any other automated tools, processes, or methods to access the Platform or any data or information;

(e) use the Platform in any manner that could damage, disable, overburden, impair, or compromise Mindoo’s systems or security, or interfere with the use of the Platform by other Users.

5. Intellectual Property Rights

5.1 Mindoo (or its licensors) remains the sole owner of all intellectual property rights in the mindoo platform. This includes, among other things, the underlying ideas, questionnaires, user interfaces, algorithms, models, methods, software code (both source and object code), and any new versions, updates, improvements or modifications.

5.2 Except for the limited license described in Section 2, you are not granted any other rights. These Terms of Service do not transfer any ownership or intellectual property rights to you or any third party. You do not acquire any rights of ownership or control over the Platform in any way.

6. Disclaimer and Warranties

6.1 The platform and the services by Mindoo are provided “as is”. To the maximum extent permitted by applicable law, Mindoo does not make any other promises or guarantees whether express or implied and rejects all warranties, including (but not limited to) any implied guarantees about the accuracy or completeness of data, fitness for a particular purpose, merchantability, or non‑infringement. We do not guarantee that the Mindoo platform, or any content on it, will always be available or be uninterrupted.

6.2 You understand and agree that Mindoo’s platform is not intended, nor designed to function as a medical device and it serves solely as an administrative support tool, and all medical decisions and actions remain under the exclusive responsibility of qualified healthcare professionals.

6.3 You understand and agree that Mindoo’s platform makes use of artificial intelligence, and that such use must at all times be responsible, careful and informed, in accordance with the intended purpose of the Platform, applicable ethical standards within the relevant sector, and the generally accepted state of the art in artificial intelligence and related technologies.

7. Liability

7.1 To the maximum extent permitted by law, Mindoo shall not be liable to you for any indirect, punitive, special, consequential, or similar damages, including without limitation loss of profit, loss of revenue, loss of business, loss or corruption of data, loss of goodwill, reputational damage, (potential) investments, or costs associated with restoring data, arising from or related to your use of the Platform.

7.2 In any event, Mindoo’s maximum liability under these Terms of Service shall not exceed the amounts actually paid out by Mindoo’s insurer in connection with the event giving rise to the damage related to your use of the Platform.  

7.3 To the maximum extent permitted under applicable law, you agree, and accept, not to hold the advisors, agents, contractors, directors, employees, representatives and subcontractors of Mindoo personally liable for or in connection with the Terms of Service (including any extra-contractual liability claim). Any (liability) claim for or in connection with the Terms of Service shall be brought by you solely against Mindoo, except in the case of fraud.  

8. Privacy and Data Protection

8.1 We collect and process your personal data on behalf of the medical professional or hospital with whom you have an appointment. In this context, we act as their data processor and have entered into a data processing agreement in line with applicable law.

9. Choice of Law and Forum

9.1 These terms of service shall be governed by and construed in accordance with the laws of Belgium and the courts of Antwerp, division Antwerp Belgium, shall have jurisdiction, without prejudice to the consumer’s right to present a dispute before a competent court on the basis of a mandatory statutory provision.
